Smile Brands Takes Action in Landmark Data Breach Settlement

Smile Brands invests in patient protection by taking a transformed approach to data security after its breach in 2021.

Smile Brands has proactively addressed a class action lawsuit stemming from a 2021 data breach. This resolution is set to benefit those who received notification of the breach.

In April 2021, hackers breached Smile Brands’ systems, compromising data from around 1.5 million dental patients. The lawsuit alleges a failure to safeguard patient data. Although Smile Brands denies any wrongdoing, it has agreed to an undisclosed settlement sum.

Under this settlement, claimants can seek reimbursement for documented, unreimbursed losses related to the data breach, with compensation up to $5,000. Additionally, five hours of documented lost time are compensated at $25 per hour, reaching up to $125.

Class members can also receive a pro-rata share of the net settlement fund, ranging from $15 to $150, depending on participation. Furthermore, two years of free credit monitoring and identity theft insurance through Experian, valued services including up to $1 million in identity theft coverage, are offered.
